Responding to intense pressure from the usual sources William Schabas, a prominent and respected expert on international criminal law, recently resigned as Chair of the UN expert commission of inquiry into war crimes allegations arising from the massive Israeli military operations in Gaza during July and August of 2014.
These issues relating to international criminal accountability have also received recent prominence due to Palestine’s adherence to the Rome Treaty making it a party to the International Criminal Court, an initiative that generated an enraged punitive reaction on the part of Israel as well as an angry denunciation by Washington. On display in these instances is the struggle between extending the rule of law to international state crimes and the geopolitical resistance to such an effort whenever accountability to law is in tension with the pursuit of strategic interests.
Imposing international criminal responsibility upon political leaders and military commanders that occur in the aftermath of wars possesses a dual character from a geopolitical perspective: to vindicate major military undertakings of liberal democratic states and to ensure impunity for the leaders of these same states in the event that their behavior or that of their allies are alleged to be international crimes.
These efforts at vindication are associated with strengthening the global rule of law and validating the established order, while impunity is invoked to insulate powerful individuals and their governments from criminal accountability. The resulting pattern in international life is one of double standards at the level of implementation and hypocritical rhetoric about the importance of a global rule of law based on its universal applicability.
Contemporary experience with these issues is grounded in the aftermath of World War II.
Let us start by summarizing. We are looking at six major leaders of forces and movements shaping centuries – Churchill-Hitler-Stalin-Mao-Gandhi-Mandela – comparing, two at a time. We are looking for similarities and dissimilarities. Some of them are out in the open, in their spoken ideologies. But most of them – maybe the most interesting–are hidden to the untrained eye. There are the similarities when they are from the same civilization and the dissimilarities when different – however much they profess to be on the same or very different lines. The six were themselves hardly aware of this factor.
As Churchill, Hitler and Stalin share the Christian-secular civilization; we would expect anti-Semitism, racism, and little hesitation when killing–by war, starvation (the Lord also did it), by revolution, millions – even with enthusiasm. Deeper down there are deductive reasonings from axioms about race and class and a final state: the British Empire, the Aryan Reich, for one thousand years, and socialism on the way to the final stage, communism forever; run from London, Berlin, Moscow. So we got the triangular Second World War with Moscow entering two alliances of convenience.
Enters Mao. He shares the word “communist” with Stalin (they still use it, long after it disappeared in USSR-Russia). But the Chinese civilization leaves its indelible imprint on that concept, giving the word a very different meaning, commune-ism, common-ism, doing things together, cooperating.
Enters Gandhi. An Asian like Mao, but watch out: there is no Asian civilization. There are West, Central, South–Hindu; Gandhi is here!–Southeast, East–Mao is here!–Asia; all very different–and a sixth, North Asia, Russian Orthodox.Read More »
American Middle East interventionists chide President Barack Obama for not doing more. Why is the US running away from Yemen, why didn’t the US go into Syria and depose President Bashar al-Assad, why did Obama pull troops out of Iraq prematurely, why isn’t he putting “boots on the ground” in the fight against the Islamic State (ISIS)? Why, in short, doesn’t the US use its military might to subdue the stormy parts of the Middle East?
The first answer must be that he does not have to be George W. Bush’s surrogate. It was Bush who triggered much of the upheavals with his invasion of Iraq – although ex-President Jimmy Carter bears the responsibility for arming the Taliban and thus the establishment of Al Qaeda in Afghanistan. Why should Obama want to continue to try and mop up after Bush’s dirty work, especially as more intervention is likely to up the ante rather than calming the situation?

Churchill and Hitler made history but did not change it; after the war their societies found their old forms. Stalin and Mao changed their much bigger societies basically, and gave the Westphalian state system new fault-lines, alliances: anti-Russia-USSR, anti-China-DPRC.
There was also a short lasting USSR-DPRC alliance 1949-53, when Stalin was alive. But when he was murdered the banner as leader of the rapidly expanding Communist World was not passed on to the biggest country, but stayed in Moscow. The new leader was not Mao Zedong but the colorless Malenkov. Surface level conflict; and important.
But the concept of a monolithic Communist as opposed to a Free world survived in a US mind slow at capturing or admitting deeper aspects of reality, but quick at projecting themselves on the world.
The deep differences between the Western civilization of which Russia was and is a part, and Chinese civilization of course also affected their communisms. So let us explore what happened to these two huge projects.
They were similar on three basic points: ending feudalism in the countryside; capitalism in the cities down; and imperialists – foreign forces – out. On Saturday President Barack Obama was at the commemoration ceremony to mark the 50th anniversary of the Selma March led by Martin Luther King which gave the push for legislation that ensured black people the right to vote. Obama’s speech was breathtaking oratory – surely one of the top three speeches in the American history of the last 150 years.
The fifteen minute speech was delivered without script or teleprompter. It ranged from history to philosophy, from politics to poetry. Every sentence was perfectly structured. The arguments were sharp and delivered with awesome authority and soaring elegance. Obama is the poet of prose.
For those who say the only significant thing about Obama’s presidency is that he is the first black to hold the post I tell them to watch this on YouTube. Obama’s speech should be remembered in 150 years time as much as is Lincoln’s speech of 150 years ago today.
It is quite appalling to see in Congress and the media people with far less brain power carping against him, resisting his legislation or mocking his foreign policy. Sometimes the criticism seems to be racially motivated even if subliminally.
To his credit ex-president George W. Bush (always reasonably good on race issues) joined Obama on the march. But the Republican leaders of Congress did not. And where were the foreign leaders who recently flooded to Paris to protest the murders of the staff of Charlie Hebdo?
Everyone will take away from that speech a sentence or argument that touches them. What struck me most was that it reminded us not to underestimate the politics of change.
Fifty years ago not only could no one have imagined that there would be a black president no one would have expected the rapid social and economic progress of black Americans. Their well-paid middle class has swelled producing CEOs of major companies like McDonalds and American Express. They are found in the top ranks of hospitals, banks, universities, government, diplomacy, the law, the military, film and theatre, not to mention politics.
It is true that too many have been left behind or put behind bars. But if this could be achieved then it is likely that in the next decades the poverty of poor blacks will also be greatly diminished now that Obama has restored the mighty engine of American economic growth, which is motoring at a pace far ahead of its European and Japanese partners.
I was on the Selma march.
It touched my life profoundly. It turned me at a young age into an optimist. I remain so today.
For 40 years I have written columns and books about the Third World and its development. I have watched those who say that bad leadership, a harsh environment and wasted aid could never make a dent in its poverty be proved wrong. The fact is the goal of halving the share of people living in extreme poverty has been met.
According to last week’s Economist, in 1990 36% of the world’s population lived in abject poverty. By 2010 it was down to 18%, and falling. So the number of very poor people has gone down from 1.9 billion to about 1 billion today. The World Bank has declared that its objective is to see the worst kind of poverty completely eliminated by 2030.
I have written about the village of Piloezinhos in the poverty stricken north east of Brazil once every ten years or so over 40 years. I’ve seen it move step by step from misery to successful growth. From no sanitation, no decent road, no health service and no school to where today it is a thriving village with flush toilets, a health centre with a full time doctor, a bustling primary school, a radio station and a good road to town.
Every visit I have made in recent years has refreshed my optimism about Third World development.
Some more statistics: In 1990 30% of the developing world lacked access to clean water. In 2008 the world reached the UN’s goal of halving that proportion to 15%. Today it is around 11%. In the same period maternal, infant and child deaths have plunged by 50%. In 1990 12 million children under five died each year. Today fewer than 7 million do. Global spending on vaccines has tripled since 2000. They are now saving three million children in developing countries annually.
There are new UN goals being formulated with a target date of 2030: to achieve universal access to clean water, to ensure universal access to sexual and reproductive health services, to ensure that all girls and boys have access to good quality childhood development and pre-primary education, the ending of child labour and the reduction of the worst of poverty by another 50%.
We optimists can make this happen. In the words of Obama: “Yes, we can!”
President Richard von Weizsäcker passed away 31 January and was very much celebrated in Germany for his brilliant presidency to normalize a Germany with a troubled past, even divided on top of that. But, by and large leaving out his global perspectives mentioned below.
His brother Car Friedrich was a nuclear physicist turned peace activist with a wonderful peace program, in one word: Weltinnenpolitik, world domestic policy (well, it depends on the country, some domestic policies are better than others; I would go for a Swiss coalition governance, federalism, direct democracy).
The president’s nephew Ernst Ulrich is an energy-environment leader, in Germany and through the UN in the world.

On March 3, 2015, The Telegraph and a few other major news surces broke the quite extraordinary story that the chairman of the Nobel Peace Prize Committee – the body that decides who is awarded the Prize – former Norwegian PM Thorbjoern Jagland had been demoted; it’s the first time it has ever happened.
It was during his chairmanship the will of Alfred Nobel was ignored most systematically – e.g. by awarding the world’s allegedly most prestigious prize to President Obama, the EU and Chinese human rights (but pro-war) Liu Xiaobo.
It’s about 7 years ago that a small group of Scandinavian scholars decided to investigate how this prize is managed. The basic research can be found in a book by Norwegian lawyer and author, Fredrik S. Heffermehl, The Nobel Peace Prize: What Nobel Really Wanted which was the first major result of the group’s work. It documents how this prize is “prestigious” only for those who either a) have never read Alfred Nobe’s will; b) don’t believe it should be interpreted with respect for his motives and goals and c) have very little knowledge about peace and peace research.
Nobel’s formulation in his will is short and clear – the Peace Prize shall go “to the person who shall have done the most or the best work for fraternity between nations, for the abolition or reduction of standing armies and for the holding and promotion of peace congresses.” He calls such people “champions of peace”. Thus, the Nobel Peace Prize is not a do-good prize, not a human rights or environmental prize and not a pro-war prize. But it is a reward work for disarmament, anti-militarism and the abolition of warfare and people – be it politicians, scholars, activists – who are pro-peace, champions of peace. Over the years, the criticism of the Nobel Peace Prize Committee’s work has increased. Seven years ago, I cannot remember that any journalist who interviewed me about the Prize had read the will. Now about 75% of them seem to have before they call.
Fredrik Heffermehl, Oslo, and Tomas Magnusson, Gothenburg, have now established the Lay Down Your Arms Association which was incorporated and registered in Gothenburg, Sweden in 2014 with a Scandinavian and an International Advisory Board. The Nuclear Zero lawsuits, initiated by the Marshall Islands, are about the law, but they are about much more than the law. They are also about saving humanity from its most destructive capabilities. They are about saving humanity from itself and about preserving civilization for future generations. They are incredibly important, and I will try to place them in a broader context.
I will begin by sharing two quotations with you. The first is by Jayantha Dhanapala, a Sri Lankan diplomat, former United Nations Under-Secretary General, and long-time and committed leader in the area of nuclear disarmament. He states: “The spectre of the use of a nuclear weapon through political intent, cyber-attack or by accident, by a nation state or by a non-state actor, is more real than we, in our cocoons of complacency, choose to acknowledge.”
The spectre of nuclear use, even nuclear war, is real and most of the world lives in “cocoons of complacency.” It is clear that we must break free from those cocoons, which are as dangerous to the human future as are the nuclear weapons that now imperil us. The Nuclear Zero lawsuits seek to accomplish that.
The second quote is by His Holiness Pope Francis, the leader of the Catholic Church, who has brought new light and compassion to his office. He states: “As long as so great a quantity of arms are in circulation as at present, new pretexts can always be found for initiating hostilities. For this reason, I make my own the appeal of my predecessors for the non-proliferation of arms and for disarmament of all parties, beginning with nuclear and chemical weapons disarmament.” The Pope talks about disarmament in general, but he puts nuclear disarmament, along with chemical weapons disarmament, at the top of his list.
Pope Francis continues: “We cannot however fail to observe that international agreements and national laws — while necessary and greatly to be desired — are not of themselves sufficient to protect humanity from the risk of armed conflict. A conversion of hearts is needed which would permit everyone to recognize in the other a brother or sister to care for, and to work together with, in building a fulfilling life for all.”

Perhaps, the most hopeful recent development in human affairs is the emergence of Pope Francis as the voice of global conscience. Although Francis speaks with papal authority to the 1.2 billion Catholics in the world, he also increasingly speaks with human authority to the rest of us. How significantly this voice will resonate might be viewed as the ultimate test as to whether ‘soft power’ is overcoming the geopolitical death dance that imperils the human species as never before.
When visiting occupied Palestine in May of 2014 Francis prayed at the notorious Israeli separation wall in Palestine that the World Court had ordered dismantled as unlawful back in 2004. The pontiff chose to pray near a scrawled graffiti that read ‘Pope, we need some 1 to speak about justice.’ While in the Holy Land Francis articulated what justice should mean in relation to the Palestinian reality: the pope called the existing situation ‘increasingly unacceptable,’ defied Israel by speaking of the ‘State of Palestine’ while touring the West Bank, and urged the establishment of a ‘sovereign homeland’ for the Palestinian people where there would be freedom of movement (so long denied).
By this visit and declaration, Pope Francis indirectly underscored the ethical insight of Nelson Mandela and Archbishop Desmond Tutu that after the collapse of apartheid in South Africa, the great symbolic moral challenge directed at the conscience of humanity is the empowerment and liberation of the Palestinian people. Such an affirmation also confirms Francis’ credentials as an independent world leader who will not defer to Washington’s craven submission to Israel’s continuous trampling upon Palestinian rights.
More broadly, Pope Francis has made it repeatedly clear that he is a critic of global inequality and of a capitalist world economic system that has produced ‘plunder of nature,’ a ‘frenetic rhythm of consumption,’ and worship of ‘the god of money.’ Above all, according to the German cardinal, Walter Kasper, this is a pope who “wants to lead faith and morality back to their original center” in authentic religious experience.

Prefatory Note This post is a much modified piece published a few days ago in AlJazeera English, and republished elsewhere on line. As many have now done it tries to enlarge the context in which the Charlie Hebdo events are understood beyond a highlight film clip in ‘the war on terror.’ The alleged link between the Chouachi brothers and Al Qaeda of the Arabian Peninsula (AQAP) allows the attack on Charlie Hebdo to be experienced as the French 9/11, and with this a return of France to a status of post-colonial geopolitical relevance.
Without grasping the relevance of how the dominant treat the dominated within our societies and throughout the world, we are consigning ourselves to many repetitions of the private and public horrors experienced in France on January 7, 2015.
There is some common ground, but not much. The killings in Paris last week were horrifying crimes that expose the vulnerability of democratic societies to lethal vigilante violence, whether facilitated from outside or as a spontaneous expression of homegrown psychopathic alienation. Beyond this naked, morbid reality associated with the murder of the Charlie Hebdo cartoonists, police officers, and the supermarket hostages there is nothing but darkness, and in that darkness some dangerous monsters lurk.
We can be again thankful for the moral clarity of Pope Francis who a few days ago in the impromptu setting of a plane taking him from Sri Lanka to Manila shined a light upon the darkness. Unlike those who so ardently wielded the slogan “Je suis Charlie” the Pope understood that free speech without limits is an invitation to indulge the worst negative impulses that will then operate as viruses destroying the vital organs of the body politic.
